‘PARASCADD Gold, also called PGOLD, is EPC Cloud Software platform (from now on Portal in this document), hosting all EPC Products required for the EPC Industry.

PGOLD also offers ORGANOGRAM, CALENDAR, TO-DO LIST, and TIMESHEET with Man Hour Booking for Project Activities, integrated with Primavera, MS-Project, & PROPLAN.

Platform Availability for EPC Software:

1. On Customer Cloud

   PGOLD is available for deployment on Your Cloud Servers Infrastructure. So, you can use it from within your organization.

2. On PARASCADD Cloud

   PGOLD is available for deployment on Our Cloud Servers Infrastructure. And You can use it via a browser from your organization.

3. On Premise

   PGOLD is available for deployment on Servers in your premises within your LAN/WAN. So, you can use it from within your organization.

Please do not reveal these details to fraudsters and imposters claiming to be calling on PARASCADD’s or our associates behalf. You may report such suspicious activities to info@parascadd.com.

What information we take from users

Personal data that you provide to us. We do not store or take your payment information you provide to the third party payment gateway. Personal data about your use of our portal.

This is technical information and includes details such as your IP address, your login information (where applicable e.g. with “ https://parascaddgold.com Experience”), time zone setting, details of how you navigated our portal, what pages you viewed or searched for, page response times, download errors, length of visits to certain pages, phone number used to call our customer service number.

We take your email address, first name, and last name at the time of Signup to https://parascaddgold.com portal.

We send emails only for reset password, products updates, help and information from the portal.

Warranty

The Software is provided on an ‘as is’ and ‘as available’ basis and the Licensor makes no warranty of any kind with respect to the Software meeting your requirements or that the Software will be without fault or that the working of the Software will be uninterrupted or error free.

Since this software platform provides SAAS products accessible via a standard browser, no installation whatsoever is needed on your (user’s) computer and hence is not at all intrusive to your systems.

You the user also agrees that whatever files you upload are free of viruses and malware or malicious software. You will be held responsible if uploads are malicious and legal proceedings may be initiated against you.

Refund Policy

If a user discovers any issues which stalls the operations of the user or affects their business, they should inform us on support email support@parascadd.com or via our support portal http://support.parascadd.com. We will take all reasonable endeavours to correct the problem or issue so that they can resume their operations on our portal. If the user still cannot proceed their operations within 30 days of their report, we will refund the license fee.

Intellectual Property

It is categorically stated that the portal https://parascaddgold.com is the intellectual property of PARASCADD Private Limited and reserves all rights to this software as a service portal.

The user is only provided permission for use this portal online via a standard browser. The users do not have the right to reverse engineer, decompile, disassemble or create derivative works of or modify the Software. Doing so will be construed as an infringement of the Licensor’s (PARASCADD Private Limited) copyright in the Software.

Unauthorized use of the portal (https://parascaddgold.com) will result in a breach and direct termination of the Licenses, and You agree that it will be construed as an irreparable harm to the Licensor (portal owners), subjecting you to legal proceedings initiated by the Licensor and would entitle the Licensor to claim reliefs against you as the Licensor (portal owner) may deem fit in accordance with the provisions of law as may be applicable from time to time.

Limited Liability

• The material displayed on the portal is provided on an ‘as is’ basis, without any guarantees, conditions or warranties as to its accuracy, quality, content, completeness, or adequacy and is subject to change without notice.
  
  To the extent permitted by law, PARASCADD and any third parties connected to us hereby expressly exclude:
  
• All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.
• Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with the portal, any websites linked to it or from it and any materials posted on it including but not limited to any one or more of the following:
• Loss of income or revenue;
• Loss of business;
• Loss of profits or contracts;
• Loss of prospective economic advantage;
• Loss of anticipated savings;
• Loss of data;
• Loss of goodwill;
• Wasted management or office time; and
• Whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of or damage to your tangible property or any other claims for direct financial loss that are not excluded by any of the categories set out above.

We recognize only to the liabilities applicable as per the Laws of India. We are not liable for fraudulent misrepresentation of our company, or any of our portals, apps, application on the internet.

Indemnity

The user agrees and acknowledges that they shall indemnify https://www.parascaddgold.com in the event of any damage or loss incurred by the use of this platform on account of your violation of the terms of this EULA, by omission or wilful misconduct.

Applicable Law

This Agreement shall be governed by and interpreted and construed in accordance with the Laws of India and the user submit themselves for the exclusive jurisdiction of the Courts at Mumbai.
